  • You agree to accept responsibility for all activities that occur under your account

4. User Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding the accuracy or reliability of AI-generated content
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the security of data transmission

12. Limitation of Liability

To the maximum extent permitted by law, 1Bit AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your account
  • Damages resulting from any conduct or content of third parties
  • Damages resulting from AI-generated content accuracy

Liability Cap: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless 1Bit AI and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right
  • Any content you submit through the Service

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution:

  • Any disputes shall be resolved through binding arbitration
  • Arbitration will be conducted by the American Arbitration Association
  • You waive any right to a jury trial or class action lawsuit
  • Small claims court disputes are exempt from arbitration

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

  • In-app notification when you next access the Service
  • Updated terms posted on our website
  • Continued use constitutes acceptance of new terms
